These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User") and VitaBurn AI Technologies ("Company") for use of our health and wellness applications. By creating an account or using any service, you confirm that you are 18 years of age or older and agree to these Terms.
VitaBurn AI Technologies provides the following digital health services:
⚕️ NOT A MEDICAL DEVICE: VitaBurn AI, VitaPoshan AI, and VitaPoshan are wellness and lifestyle tracking tools. They are NOT medical devices, NOT registered under CDSCO (Central Drugs Standard Control Organisation) under Medical Device Rules 2017, and NOT licensed as diagnostic tools.
⚠️ NO DIAGNOSIS: Disease risk scores, metabolic age calculations, calorie recommendations, and health metrics are AI-generated educational estimates based on population-level research (Framingham, FINDRISC, Indian Diabetes Risk Score). They do NOT constitute medical diagnosis, treatment, cure, or prevention of any disease. They are for lifestyle awareness only.
🔬 NOT CLINICALLY VALIDATED: Our risk formulas are not clinically validated for individual diagnostic use. Accuracy varies by individual — always validate with clinical tests from a certified laboratory.
🤖 AGNI AI LIMITATIONS: Our AI assistant (AGNI) provides educational wellness information only. Per Indian Telemedicine Practice Guidelines 2020 and AYUSH Telemedicine Guidelines 2020, AI platforms are NOT permitted to prescribe medicines, diagnose conditions, or replace medical consultation. AGNI does not prescribe, diagnose, or treat.
👨⚕️ CONSULT A DOCTOR: Always consult a qualified registered medical practitioner (MBBS/BAMS/BHMS/etc.) before making any health, medication, or treatment decisions. Do not rely solely on our app for medical decisions.

By using VitaPoshan Technologies apps, you acknowledge and accept these accuracy limitations.

All content on VitaBurnAI, VitaPoshan AI, and VitaPoshan — including AI models, disease risk algorithms, Indian food database, Ayurvedic recommendations, UI design, and branding — is the exclusive intellectual property of VitaBurn AI Technologies. Unauthorized reproduction or commercial use is strictly prohibited.
To the maximum extent permitted by Indian law, VitaBurn AI Technologies shall not be liable for:
Our maximum liability is limited to the amount you paid for the service in the preceding 3 months.
We reserve the right to terminate or suspend your account immediately if you violate these Terms. You may delete your account at any time from within the app (Profile → Privacy & Data Rights → Delete My Account). Upon termination, your data will be deleted within 7 working days as per DPDP Act 2023.
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Pune, Maharashtra. We encourage resolution of disputes through mutual discussion before legal action.
We may update these Terms. Significant changes will be notified via email or in-app notification. Continued use after changes constitutes acceptance of the new Terms.
